1. About us
This website is operated by Ember and Eave, an online shop based in Nottingham, United Kingdom ("we", "us", "our"). You can contact us at info@emberandeave.co.uk. By using this website or placing an order, you agree to these terms. Please read them, together with our Shipping Policy, Returns & Refund Policy and Privacy Policy.
2. Orders
When you place an order you will receive an email confirming we have received it. This is not yet acceptance. Our contract with you is formed when we dispatch your order and email you to say so. We may decline an order, for example if an item is unavailable, a price or description contains an obvious error, or we suspect fraud. If we decline an order after taking payment, we will refund you in full.
3. Products
We try to describe and photograph our products accurately. Some product photos are styled or illustrative, and colours may look slightly different on your screen. Sizes and measurements are approximate. Please read each product description carefully, including whether bulbs are included and whether a light needs to be installed by a qualified electrician. Hardwired ceiling, pendant and wall lights must be installed by a qualified electrician in line with UK wiring regulations.
4. Prices and payment
Prices are shown in pounds sterling (GBP). Delivery charges are shown at checkout before you pay. For UK orders of £135 or less, the price at checkout is the full price. Orders over £135 and orders outside the UK may be subject to import taxes, duties or carrier fees, which are the customer's responsibility (see our Shipping Policy). Payment is taken when you place your order. We may change prices at any time, but changes will not affect orders already placed.
5. Delivery
Delivery times and costs are set out in our Shipping Policy. Delivery times are estimates. Responsibility for the goods passes to you when they are delivered to the address you gave us.
6. Cancellations, returns and your rights
You can cancel your order and return items as explained in our Returns & Refund Policy. If you are a consumer, you have legal rights in relation to goods that are faulty or not as described, including under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. Nothing in these terms affects those rights.
7. Our responsibility to you
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care, but we are not responsible for loss or damage that is not foreseeable. We supply products for domestic and private use only and are not liable for any loss of profit, loss of business or business interruption. We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for breach of your legal rights as a consumer. We are not responsible for delays or failures caused by events outside our reasonable control.
8. Using this website
You must not misuse this website, including by attempting to gain unauthorised access, introducing viruses, or copying content without our permission. Text, images and designs on this website belong to us or our suppliers and licensors.
9. Your information
We use your personal information as described in our Privacy Policy.
10. Changes to these terms
We may update these terms from time to time. The version in force when you place your order applies to that order.
11. Law and disputes
These terms are governed by the law of England and Wales. If you are a consumer, you can bring legal proceedings in the courts of England and Wales, or in the courts of Scotland or Northern Ireland if you live there. If you have a complaint, please contact us first at info@emberandeave.co.uk and we will do our best to resolve it.
